Missed Unemployment Filing Deadline, Benefits Recovered

A client lost access to unemployment benefits during the COVID-19 period after missing the filing deadline, but legal advocacy helped recover the support they should have received.

During the COVID-19 pandemic, many people faced sudden job loss while also trying to understand rapidly changing benefit rules. For some, the problem was not unwillingness to file. It was confusion over whether they even qualified and how the process worked.

In this matter, our client did not apply for unemployment benefits on time because they did not realize they were eligible and did not understand the filing process. By the time they understood what had happened, the deadline had already passed and important financial support had been lost.

When the client came to us, the matter was no longer straightforward. The case required careful review of the facts and timeline, communication with the Department of Labor, and additional supporting materials to explain why the filing was delayed.

We spent substantial time organizing the record, clarifying the client's situation, and advocating persistently on the client's behalf. In the end, we were able to help recover the benefits that should have been available to them.

Case Story/02/Immigration Status Maintenance

H-1B Transfer Complications Created Sudden Status Risk

An international student changed employers through an H-1B transfer, but the prior H-1B was withdrawn and the new filing did not stabilize, creating serious immigration risk before the client fully understood what had happened. The eventual strategy included a B-2 bridge followed by a return to F-1 study.

In this matter, an international student changed jobs through an H-1B transfer and began working for the new employer. But the case was more complicated than it first appeared.

A key problem arose during the transition: the prior employer had already withdrawn the original H-1B, while the new H-1B transfer did not fully stabilize and was later withdrawn as well. What looked on the surface like an employment change quickly became a status-risk case.

That kind of situation can be especially dangerous because the client may not immediately realize that status problems are already developing. Depending on the timeline and filings, the consequences may include out-of-status concerns, possible immigration complications, and increased risk in future visa or green card matters.

Fortunately, the client had a pay stub from the new H-1B transfer employment. That did not automatically solve the problem, but it became an important supporting record when reconstructing the timeline, analyzing the client's actual work history, and evaluating possible remedial options.

After getting involved, we carefully reviewed the filing record, the withdrawals, the employment timeline, and the available supporting documents. Based on that review, we first used a B-2 filing as a bridge to help preserve lawful presence during the transition period, and later structured a return to F-1 status so the client could continue studying in the United States.
